GST Demand Notice? How to Reduce Your GST Payment

Received a GST demand notice for excess ITC, tax mismatch or a missed notice? Review the demand before paying lakhs or crores unnecessarily.

You may have received a GST demand for a previous years, an input tax credit mismatch, excess ITC, unpaid reverse charge (RCM) or incorrect GST returns. Perhaps you missed a communication on the GST portal, did not submit a reply on time, and now a final demand order has been passed.

The problem becomes serious when interest and penalty increase the amount, recovery action begins, or your business bank account faces attachment. Your CA consultant may be advising you to pay the demand, but have the actual figures, supporting documents and legal grounds been examined before making that decision?

Do Not Ignore the Notice. Do Not Assume the GST demand Is Correct.

A GST notice or order needs a proper examination of the financial records, tax calculations, ITC eligibility, legal provisions and procedural history. Missing the next deadline can make your options more difficult.

Why Has the GST Department Raised Such a Demand?

ITC Mismatch

Excess or duplicate credit, GSTR-2B differences, supplier non-compliance or ineligible purchases such as certain vehicle expenses or personal-use items.

Unpaid GST Liability

Output GST reported but unpaid, reverse charge liability not discharged, or incorrect tax payment.

Return & Transaction Differences

GSTR-1 and GSTR-3B differences, e-way bill mismatches, turnover discrepancies or incorrect GST rates.

Missed Notices & Orders

Scrutiny notices not answered, show-cause notices missed, rejected replies or appeals not filed within time.

How DSCSign’s Sreedhar Review a GST Demand

We start by examining the notice, final order and GST portal history—not merely the amount demanded. Our team then checks the relevant returns, GSTR-2B, purchase invoices, vendor details, tax payments, e-way bills and supporting records to identify discrepancies and possible legal grounds.

Based on the stage of the case, we prepare the appropriate written response, representation, rectification request or appeal and pursue the matter through the ACCT/ JC GST authorities. The objective is to establish the correct tax position and seek deletion or reduction of any demand that is not legally sustainable.

Our Specialist GST Demand Engagement

Handled through Sreedhara S team in Bangalore.

For GST demands above ₹50 lakh

This specialist demand-review engagement is intended for selected high-value cases above ₹50 lakh, subject to document review and acceptance. Smaller demand matters are outside this specialist engagement.

Our approach is to protect you through legal and documentary representation—not shortcuts. A demand may be reduced, rectified or set aside only where the facts, evidence and applicable legal remedies support that outcome.

GST Notice for payment? First Identify What You Received

Many business owners miss GST office communications because they completely depend entirely on their GST filing consultant. By the time they notice the communication, the department may have moved to the next stage.

Check your GST portal notices, orders and return-related communications. These are some important forms you should recognise:

ASMT-10

Return Scrutiny Notice

The department has identified a return discrepancy and seeks your explanation. Review the figures and respond with supporting records.

DRC-01A

Pre-notice Intimation

The department communicates an ascertained liability before the relevant show-cause notice. Examine the calculation and submit appropriate information or payment details.

DRC-01

Show-Cause Notice Summary

A summary accompanying a GST show-cause notice. The detailed notice and allegations must be examined before preparing a reply.

DRC-07

Demand Order Summary

The demand has been adjudicated and the order summary uploaded. Immediate review of the order, communication date and available remedies is important.

What If You Have Already Received a Final Order?

Do not assume that the case is over. We first examine whether the order contains an apparent clerical or arithmetical error, whether the submitted evidence was considered, whether a hearing or proper opportunity was given, and whether the demand has been correctly calculated.

Depending on the facts, the available route may involve a rectification request under Section 161, an appeal under Section 107, or another legally appropriate remedy. Rectification is not a substitute for appeal, and the statutory time limits must be checked immediately.

Do Not Miss the Appeal Deadline

A first appeal under Section 107 is ordinarily required within three months from communication of the order. A further period of up to 1 month may be allowed if sufficient cause is established. The applicable statutory pre-deposit must also be considered.

Keep These Documents Ready

  • GST notice, complete final order and DRC forms.
  • GSTR-1, GSTR-3B and GSTR-2B for the disputed periods.
  • Purchase and sales registers, invoices and vendor details.
  • Electronic credit ledger, cash ledger and payment challans.
  • E-way bills, reconciliation statements and previous replies or appeal papers.

At DSCSign GST team first identify the stage of the proceedings, the grounds of demand and the available legal options. This initial classification helps avoid wasting time on the wrong remedy while recovery or appeal deadlines are approaching.

GST Demand Reasons: Check Where Your Business Went Wrong

A GST demand can arise from a genuine tax shortfall, an incorrect calculation, a return mismatch or an interpretation dispute. Before paying the amount, identify exactly which transaction, return period and legal provision the department has questioned.

1. Excess Input Tax Credit

ITC claimed in excess of eligible credit, duplicate entries or differences between purchase records and GSTR-2B.

2. Ineligible ITC

Credit claimed on blocked, personal or otherwise ineligible expenses. Motor vehicles and certain other purchases need specific eligibility checks.

3. Supplier-Side ITC Issues

Supplier reporting differences, missing invoice details or disputes about whether the supplier discharged the applicable tax.

4. Reverse Charge Not Paid

RCM liability reported but not discharged, or reverse charge transactions not properly accounted for.

5. Output GST Unpaid

Sales liability declared in returns but the corresponding tax remains unpaid or short-paid.

6. Sales and Purchase Mismatch

Unexplained differences between reported turnover, purchase values, books of accounts and GST returns.

7. E-Way Bill Differences

Movement records, invoice values, quantities or e-way bill details do not reconcile with reported sales.

8. Wrong GST Rate

A product or service was reported at a lower rate than the rate considered applicable by the department.

9. Missed Notice or Scrutiny

A notice was not answered, supporting documents were not submitted or the case proceeded to an adverse order.

How Sreedhara Examines These GST Demands

We do not simply advise you to pay the demand or file a standard appeal. The team first reconstructs the disputed transactions and checks the figures against the actual records.

  • ITC review: Compare GSTR-2B, purchase invoices, books and applicable ITC eligibility conditions.
  • Tax reconciliation: Match GSTR-1, GSTR-3B, sales records, e-way bills and tax payments.
  • Supplier and RCM review: Examine vendor records, invoice conditions and reverse charge liability.
  • Order examination: Identify calculation errors, missing evidence, overlooked submissions and legally sustainable grounds.
  • Remedy selection: Decide whether a reply, rectification, appeal or other statutory action is appropriate.

One Important Point About Ineligible ITC

Not every vehicle or gold-related purchase is automatically eligible or ineligible. Credit depends on the nature and business use of the purchase and the specific restrictions under GST law. We examine the actual transaction rather than accepting a blanket classification.

Our objective is to separate genuine tax liability from incorrect or unsupported demands. Where the department’s calculation or conclusion is not sustainable, we prepare the relevant evidence and legal grounds to seek appropriate relief. Where tax is genuinely payable, we explain the available lawful options instead of promising an unrealistic cancellation.

How We Challenge GST Demands: Our Case-Handling Method

A GST demand cannot be handled by simply sending an email or filing a routine appeal. The case needs to be understood from the original transaction, the GST returns, the department’s allegations and the final order. This is where Sreedhara S and GST team personally examine the matter and prepare a case-specific strategy.

1

Examine the Notice and Final Order

We check the allegations, financial years, sections invoked, demand calculations, previous replies, hearing records and current procedural stage. We identify what has actually been demanded and which deadlines are still available.

2

Reconcile the Actual GST Figures

Our team examines GSTR-1, GSTR-3B, GSTR-2B, purchase and sales registers, invoices, vendor records, e-way bills, electronic ledgers, tax payments and RCM transactions. This helps identify duplicate demands, incorrect ITC calculations, reporting differences or unsupported allegations.

3

Identify Legal Grounds and Precedents

We examine applicable ITC provisions, the correct demand section for the financial year, limitation, jurisdiction, the evidence relied upon, procedural compliance, interest and penalty calculations. Clerical errors, omissions, incorrect calculations, overlooked submissions and relevant judicial decisions are considered wherever applicable.

4

Present the Case to the GST Authorities

Sreedhara coordinates the preparation of detailed written submissions, supporting documents and clarifications, and follows up through the appropriate official channels. Where the matter requires a personal hearing or further representation, the case is placed before the jurisdictional proper officer or competent adjudicating authority. Depending on jurisdiction, this may involve the concerned ACCT or JCCT and other authorised officers.

5

Pursue the Correct Legal Remedy

Before a final order, we prepare an appropriate reply and hearing submissions. After an order, we assess whether rectification under Section 161, an appeal under Section 107 or another remedy is legally available. We do not use rectification to reopen matters that must properly be challenged in appeal.

Our Practical Strength: Personal Case Involvement

A strong GST representation requires more than uploading documents. It requires understanding the officer’s stated objections, preparing an issue-wise explanation, producing the right evidence, addressing applicable legal provisions and following the matter with GST officer. Sreedhara’s involvement focuses on these practical steps.

Experience Across High-Value GST Disputes

DSCSign’s past case experience, as shared by the team, includes a travel-agency matter involving an ITC demand of approximately ₹10 crore, previous-year excess ITC disputes, GSTR-1 and GSTR-3B mismatches, disputed ITC claims and notices alleging fake ITC. These matters required individual examination of records, transaction details, legal provisions and representations to the department.

Some matters have been resolved through explanations, reconciliation and appropriate representations without the full disputed amount being sustained. Other cases may require rectification or appellate proceedings. Client details are kept confidential, and these past experiences should not be treated as a promise of the same result in another case.

Recent CBIC Guidance – 26 October 2026

CBIC Circular No. 258/04/2026-GST has provided updated guidance on GST demand and appeal proceedings, including proper show-cause notices, consideration of taxpayer evidence, personal hearings and reasoned adjudication orders. We consider such developments while reviewing the merits and procedural history of each case.

Our purpose is to protect the business from an incorrect or unsustainable GST demand wherever the law permits. A genuine tax liability cannot simply be removed, but an incorrectly calculated, unsupported or legally defective demand deserves proper examination and challenge.

GST Bank Account Frozen? Act Before Your Business Cash Flow Stops

You have received a GST demand order, and now your bank account is attached or transactions are restricted. Salaries, suppliers, rent and customer payments are affected. Your business may be financially healthy, but an unresolved GST dispute is interfering with everyday operations.

Do not assume that every bank freeze follows the same GST procedure. First identify the legal provision and the actual order under which the bank has acted.

Section 79 – Recovery

After an amount becomes recoverable, the department may use statutory recovery methods. Under Section 79(1)(c) and Rule 145, a notice in DRC-13 may direct a bank or another person holding money for the taxpayer to deposit the specified amount.

Section 83 – Provisional Attachment

During specified GST proceedings, the Commissioner may provisionally attach property, including a bank account, by a written order where the statutory conditions are met. The prescribed order is generally FORM GST DRC-22.

What Should You Do Immediately?

  1. Obtain the bank’s communication: Ask for the freeze or attachment reference, issuing authority and copy of the instruction received.
  2. Download the GST order: Collect the demand order, DRC-07, DRC-13 or DRC-22, as applicable, together with previous notices and replies.
  3. Check the recovery position: Verify the date of communication, amount demanded, payment status, appeal status and any applicable statutory pre-deposit or stay.
  4. Prepare the legal response: Identify whether the attachment or recovery action can be challenged and prepare the appropriate representation or application.
  5. Follow through officially: Pursue the matter with the competent authority and obtain the written order or instruction required for the bank to release the restriction.

Can a GST Bank Attachment Be Released?

Yes, relief may be available depending on the type of attachment and the facts. For a provisional attachment under Section 83, Rule 159 provides a procedure to file an objection in FORM GST DRC-22A. After considering the objection and providing an opportunity of hearing, the Commissioner may release the property through FORM GST DRC-23 where the attachment is no longer justified.

The Supreme Court in Radha Krishan Industries v. State of Himachal Pradesh (2021) explained that provisional attachment is a drastic power and must be exercised carefully, on relevant material and for the statutory purpose. It should not be used as a routine recovery shortcut or in a manner that unnecessarily harms business operations.

Do Not Wait Until Your Entire Business Stops

Sreedhara and the DSCSign team can examine the demand order, attachment communication, bank documents and previous proceedings to identify the appropriate statutory remedy. Depending on the case, this may involve a DRC-22A objection, an appeal, an application for release or other lawful proceedings.

Our focus is to protect your business operations while addressing the GST dispute through the proper legal process. Release of an account is not automatic, and the correct remedy depends on whether the action is a Section 79 recovery measure, Section 83 provisional attachment or another lawful restriction.

GST Demand Reduction Service: Eligibility, Fees and Timeline

A large GST demand needs personal involvement, detailed reconciliation, legal research and follow-up with the appropriate GST authorities. This is different from routine GST registration, return filing or monthly compliance.

₹50 Lakh Plus

Our specialist GST demand engagement is restricted to selected cases involving demands exceeding ₹50 lakh.

From ₹10,000

Initial consultation and case assessment start at ₹10,000, depending on the records and complexity involved.

30–45 Days

Indicative period for the initial case-handling process, subject to document readiness, authority response and procedural requirements.

How Are the Professional Fees Decided?

The total professional fee depends on the amount and complexity of the demand, number of financial years involved, ITC reconciliation required, whether a final order has been passed, the availability of documents and the nature of representation required.

The jurisdictional GST office and location of proceedings may also affect the coordination, travel and time involved. For example, matters handled through different Bangalore GST jurisdictional offices may require different levels of preparation and follow-up.

After examining the available documents, we explain the proposed work, professional fee and engagement terms before proceeding. Appeals, court proceedings, specialist representation and other additional assignments may involve separate fees.

How Long Does a GST Demand Case Take?

Based on the team’s experience, an initial handling process may take approximately 30–45 days where the required records are available and the relevant proceedings permit action. However, the actual time depends on the GST authority, number of hearings, quality of evidence, procedural stage and whether an appeal or further proceeding is necessary.

A Note for Businesses With GST Demands Below ₹50 Lakh

Our specialist high-value demand-order engagement is not intended for cases below ₹50 lakh. Businesses with smaller demands can explore their regular GST compliance and advisory requirements separately through DSCSign.

Our approach is to assess the case before accepting the engagement. We do not promise that every GST demand can be cancelled or reduced. The objective is to identify the strongest lawful grounds, explain the realistic options and pursue the appropriate remedy based on the evidence.

How to Reduce Your Monthly GST Payment Legally

You do not always need to wait for a GST notice to discover that your business is paying more GST than necessary. Regular review of eligible input tax credit, sales records and applicable GST schemes can help reduce avoidable tax outflow and prevent future disputes.

1. Maximise Eligible ITC

Identify eligible business purchases and services for input credit. Check blocked credits, invoices and statutory conditions before claiming.

2. Reconcile GSTR-2B

Compare GSTR-2B with purchase records and books. Identify missing supplier invoices, duplicate claims and differences requiring follow-up.

3. Choose the Right GST Scheme

Evaluate whether the composition or regular scheme suits your business, considering eligibility, turnover, customers, input credit and overall tax cost.

4. Use LUT for Exports

Eligible exporters can supply goods or services under a Letter of Undertaking without payment of IGST, subject to export conditions and prescribed procedures.

5. Control GST Interest and Late Fees

Track return deadlines, tax payment dates, RCM liabilities and outstanding GST to avoid avoidable interest and late-filing consequences.

6. Review Sales and GST Rates

Check HSN/SAC classification, applicable tax rates, sales reporting and GSTR-1 versus GSTR-3B differences before filing.

Our Monthly GST Review Approach

DSCSign’s GST team, led by Sreedhara, reviews the purchase and sales records, GSTR-2B, ITC eligibility, outward tax liability and pending compliance. We identify missed eligible credits, incorrect classifications, supplier-side differences and payment issues that need correction or follow-up.

Better GST Planning. Better Business Cash Flow.

FAQs: GST Demand Notice, Reduction and Order Cancellation

Here are answers to common questions from businesses facing GST demand notices, ITC disputes and recovery proceedings.

1. Can a GST demand order be reduced or cancelled after it is passed?

Yes, relief may be possible where there are valid legal grounds, such as calculation errors, relevant evidence not considered, or procedural defects. Depending on the case, rectification, appeal or another statutory remedy may be available. Cancellation is not automatic.

2. My GST appeal was rejected. Can I still challenge the demand?

Possibly. We need to examine the appellate order, grounds considered, dates and available further remedies. Depending on the issue, a further appeal, writ remedy or another legally permitted step may be considered.

3. My demand is below ₹50 lakh. Will DSCSign accept my case?

Our primary specialist focus is large GST demand cases above ₹50 lakh. However, we also consider selected cases below ₹50 lakh depending on the complexity, legal merits, urgency, documents and nature of the dispute. Share your order details for an initial assessment.

4. My business bank account is frozen due to a GST demand. Can it be released?

Relief may be available depending on whether the action is a recovery measure under Section 79, provisional attachment under Section 83 or another legal restriction. We examine the relevant order and identify the appropriate statutory remedy.

5. Can you help with fake ITC allegations and GSTR-2B mismatches?

Yes. These matters require detailed examination of invoices, supplier records, purchase transactions, tax returns, ledger entries and applicable ITC provisions. The response must be supported by genuine transaction evidence.

6. How much does GST demand notice handling cost?

Initial consultation and case assessment start from ₹10,000. The full professional fee depends on the demand amount, financial years involved, complexity, jurisdiction and proceedings required. A separate scope and fee proposal is provided before accepting the engagement.

7. How long does it take to resolve a GST demand case?

The initial case-handling process may take around 30–45 days when documents are available and the required procedure permits it. Actual resolution depends on the GST authority, hearings, evidence and legal proceedings involved.
